Terms of Service Agreement

Welcome to Trendingo! These terms and conditions (the “Agreement”) govern your use of the Trendingo website located at https://www.trendingo.io (the “Site”), as well as any related services, features, content, or applications offered by Trendingo (collectively, the “Services”).

By accessing or using the Site or Services, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use the Site or Services.

  1. Description of Services

Trendingo provides a platform for affiliates to promote and sell products from our partner merchants (the “Merchants”). Affiliates may earn commissions on sales made through their unique affiliate links.

  1. Use of Site and Services

You may only use the Site and Services for lawful purposes and in accordance with this Agreement. You agree not to use the Site or Services in any way that violates any applicable federal, state, local, or international law or regulation.

  1. Eligibility

To use the Site and Services, you must be at least 18 years of age and capable of forming a binding contract. By using the Site and Services, you represent and warrant that you meet these eligibility requirements.

  1. Intellectual Property

The Site and Services, including all content, software, and technology related thereto, are owned or licensed by Trendingo and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content on the Site or Services without Trendingo’s prior written consent.

  1. Affiliate Program

Trendingo’s affiliate program allows affiliates to earn commissions on sales made through their unique affiliate links. Commissions are paid out on a monthly basis and are subject to a minimum payment threshold of $50.

  1. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRENDINGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDINGO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF TRENDINGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Trendingo and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to your use of the Site or Services, your violation of this Agreement, or your violation of any rights of another.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflicts of law provisions. Any legal action or proceeding arising out of or related to this Agreement shall be brought in the state or federal courts located in Alpena county, and you consent to the exclusive jurisdiction of such courts.

  1. Changes to Agreement

Trendingo may modify this Agreement at any time by posting the revised Agreement on the Site. Your continued use of the Site or Services after any such changes have been made constitutes your acceptance of the modified Agreement.

  1. Termination

Trendingo may terminate this Agreement at any time, with or without cause, and without notice to you. Upon termination, you must immediately stop using the Site and Services.

  1. Miscellaneous

This Agreement constitutes the entire agreement between you and Trendingo regarding the use of the Site and Services, and supersedes all prior or contemporaneous agreements, understandings, or negotiations, whether written or oral. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Trendingo’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
